Daily Bits Of ("DBO", "we" or "our") provides via our website, accessible at www.dailybitsof.com (the "Site"), an online training platform for bite-sized learning through which users (“students”) can access courses about personal development.
Our customers (“experts”) upload their own learning content which is then delivered to anyone who subscribes to the course via the Site.
Please read the following terms and conditions ("Terms of Service") carefully. These Terms of Service are a legal agreement between you and DBO and apply to you whether you are a Student (defined above) or an expert (also defined above).
Unless otherwise provided in an agreement between you and DBO, these Terms of Service govern your access to and use of the Site and the Services and all text, graphics, images, music, audio or authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services (collectively, "Content").
DBO reserves the right, at its sole discretion, to modify, discontinue or terminate the Site or Services or to modify these Terms of Service, at any time and without prior notice. If we modify these Terms of Service, we will post the modification on the Site or provide you with notice of the modification. We will also update the "Last Updated Date" at the top of this document.
The “no no's”: General Prohibitions
You agree not to do any of the following:
Post, upload, publish, submit or transmit any text, graphics, images, software, music, audio, video, information or other material that: (i) infringes, misappropriates or violates a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances.
Access, tamper with, or use nonpublic areas of the Site, DBO's computer systems, or the technical delivery systems of DBO’s providers;
Abuse or sell the contact information of your students to third-party services;
Attempt to probe, scan, or test the vulnerability of any DBO system or network or breach any security or authentication measures;
Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation via your course and/or to the students taking your course;
Use any meta tags or other hidden text or metadata utilizing a DBO trademark, logo URL or product name without DBO's express written consent;
Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services or Content;
Interfere with, or attempt to interfere with, the access of any Students, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;
Impersonate or misrepresent your affiliation with any person or entity;
Violate any applicable law or regulation or encourage or enable any other individual to do any of the foregoing.
What we can do with your Content
DBO respects the intellectual property rights of our Experts (and expects them to do the same). As an Expert, you own the copyright to your content and may edit, update or remove it from the Site and its Services whenever you want.
By publishing a course on the Site you will make it available to everyone who visits the Site.
Recognize that DBO's goal is to get as many people as possible to take our Experts courses. In order to achieve this DBO may:
Write about and share parts of a course in our newsletter.
Write about and share parts of a course on our blog.
Write about and share parts of a course on third-party blogs and publishers.
Use Content from a course in talks and interviews as a way to promote the course.
What you may do with the contact information to your students
You may contact students taking your course once they have finished your course. When doing so you must always provide a context, expressing why you contact them and why.
DBO will under no circumstances allow for experts to abuse or sell email addresses to third party users.
Break up: Termination and Account Cancellation
If you breach any of these Terms of Service, DBO will have the right to suspend or disable your Account or terminate these Terms of Service, at its sole discretion and without prior notice to you.
What you can do with the Content
When you sign up for one of our courses DBO grants you to view, save and download the Content solely in connection with your permitted use of the Services.
You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Site, Services or Content, except as expressly permitted in these Terms of Service. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by DBO or its experts.
You are not allowed to use the Site, Services or Content for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms of Service.
Regarding links to third-party sites
The Site may contain links to third-party websites or resources. You acknowledge and agree that DBO is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by DBO of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
What can we and our experts do with your email?
Our experts are allowed to contact you with offers related to the course you have just taken. We have a strict spam policy and won’t allow for any selling of email addresses.
As a student at DBO we may contact you with offers related to our Service and new courses posted on the Site.
DBO will not be held liable for any loss or damages that might result as a direct or indirect consequence arising out of the information held on this website.
Break up: Termination and Account Cancellation
If you breach any of these Terms of Service, DBO will have the right to suspend or disable your Account or terminate these Terms of Service, at its sole discretion and without prior notice to you. You may cancel your Account at any time by sending an email to [email protected]
